1. Acceptance of Terms
By downloading, installing, or using Bobble Rush ("the App," "the Game"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legal agreement between you and Bobble Rush ("we," "us," "our"). We reserve the right to update these Terms at any time. Continued use of the App after any update constitutes acceptance.
2. Eligibility
You must be at least 13 years old to use Bobble Rush. If you are between 13 and 18 (or the age of majority in your jurisdiction), you represent that you have your parent or legal guardian's permission to use the App and agree to these Terms.
By using the App, you represent and warrant that:
- You are at least 13 years of age
- You have the legal capacity to enter into a binding agreement
- Your use of the App complies with all applicable laws and regulations
3. License to Use the App
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to download and use Bobble Rush on your personal iOS device for personal, non-commercial entertainment purposes.
You may not:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Sell, sublicense, or transfer your access to any third party
- Use bots, scripts, automation, or any method to artificially inflate scores or interact with the App other than through normal gameplay
- Use cheats, exploits, hacks, or unauthorized third-party software that modifies the App or gameplay
4. Display Name (No Accounts)
Bobble Rush has no user accounts, sign-up, or login — there is nothing to register. To appear on the leaderboard, you're assigned (or may choose) a display name, tied only to an anonymous identifier stored on your device. You are responsible for:
- Not using personally identifying information as your display name
- Not impersonating any other person or entity
We reserve the right to remove or modify any display name that we deem offensive, misleading, or inappropriate.
5. Leaderboards and Competitive Play
Bobble Rush features global and friend leaderboards. By participating:
- You agree that your display name and score may be publicly visible
- You agree to compete fairly and not use any unauthorized means to inflate scores
- You acknowledge that scores and rankings may be reset at our discretion (e.g., for season resets or anti-cheat actions)
We reserve the right to disqualify, suspend, or remove any user from leaderboards for suspected cheating, abuse, or violation of these Terms without prior notice.
6. Virtual Items and In-App Content
Bobble Rush is completely free, with no in-app purchases. Virtual currency ("Coins"), bobblehead characters, and other in-app items ("Virtual Items") are earned entirely through gameplay — you cannot buy them with real money, and they have no real-world monetary value and cannot be exchanged for cash or transferred to other users.
All Virtual Items are licensed, not sold, to you. We reserve the right to modify, suspend, or discontinue any Virtual Items at any time without liability to you.
If we introduce optional purchases in a future update, this section will be updated first, and any purchase would be subject to Apple's own refund policy.
7. Advertising
Bobble Rush contains no advertising and does not partner with any ad network. If that changes in a future update, this section and our Privacy Policy will be updated accordingly before any ads are shown.
8. Intellectual Property
All content in Bobble Rush — including but not limited to the App name, logo, bobblehead characters, artwork, music, sound effects, game design, and code — is owned by or licensed to Bobble Rush and is protected by copyright, trademark, and other intellectual property laws.
"Bobble Rush" and associated logos are trademarks of Bobble Rush. You may not use our trademarks without prior written consent.
User-generated content (such as display names or shared scores) remains your responsibility. By submitting any content to the App, you grant us a worldwide, royalty-free license to use, display, and distribute that content in connection with the App.
9. Prohibited Conduct
You agree not to:
- Violate any applicable law or regulation
- Harass, threaten, or intimidate other users
- Post or transmit offensive, illegal, or harmful content
- Attempt to gain unauthorized access to the App's servers or systems
- Interfere with other users' enjoyment of the game
- Use the App for any commercial purpose without our written consent
- Engage in any conduct that could damage, disable, or impair the App
10. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your license to use the App immediately ends and any Virtual Items or progress may be forfeited.
You may stop using the App at any time by deleting it from your device.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted or error-free
- Leaderboard data will be preserved indefinitely
- The App will be compatible with all devices or iOS versions
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOBBLE RUSH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $10 USD.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above may not apply to you in full.
13. Indemnification
You agree to indemnify, defend, and hold harmless Bobble Rush and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of any third party.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Arbitration: Any dispute arising from these Terms or your use of the App shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English in the State of Delaware. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
15. Apple App Store Terms
The following terms apply with respect to your use of the App on Apple iOS devices:
- These Terms are between you and Bobble Rush only, not Apple Inc.
- Apple has no obligation to provide maintenance or support for the App
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund your purchase price (if any); Apple has no other warranty obligation
- Apple is not responsible for addressing any claims by you or any third party relating to the App
- Apple is a third-party beneficiary of these Terms and may enforce them against you
16. Changes to These Terms
We may update these Terms at any time. When we do, we will update the "Last Updated" date at the top. We may also notify you via in-app notification. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
